The following follow up communication was developed by SGE along with myself and others. It has already been responded to and the matter referred to Gregory Morse, Director of the Central Reexamination Unit. Subject: USPTO Legal Compliance Concerns
Dear Mr. Bahr,
You are being contacted again in an effort to minimize the
risk of communicating needlessly with inappropriate offices, thus creating inefficiencies.
Our concerns are outlined in the below communications and the attached.
The USPTO's inaction on reexamination 90/009,457 is deeply disturbing. The granting of this reexamination appears to have been in error. When no new SNQs exist and the examiner has been properly advised of same (16 weeks ago), then the examiner's continuing inaction to correct the situation only creates suspicions of inappropriate and possibly illegal behavior.
Your timely action in forwarding our original request was
greatly appreciated by myself as well as the investor
community. However, we wish to be assured that the
proper office, having the authority to act on our concerns,
is indeed moving to verify and promptly correct the
situation.
If it is not possible to obtain that simple confirmation,
we will be left with little choice but to solicit attention
from outside of the USPTO organization.
