It is my view that the J3 are on the hook for their customer list, I believe the agreement ( my view only) is that they will throw their clients under the bus for us ( when and only when '336 is proven valid). I Could see all their clients that use J3 products being told by J3, sorry you are on the hook and we have agreed not to indemnify you. Bingo, they all fall down. ( my view only , that was the only thing I could see as the solution of the TX case. )
