Dr. Kyle D. Chen is an associate in the Cooley Litigation department and is a member of the Intellectual Property practice group. He joined the Firm in 2009 and is resident in the Palo Alto office.

Dr. Chen represents clients in intellectual property litigation matters. He has broad educational and professional experience in electrical, mechanical and industrial engineering arts. This experience covers fields such as semiconductor fabrication, computer science, manufacturing systems, electro-mechanical integration, and operations management.

Dr. Chen has participated in International Trade Commission (ITC) investigations, including one involving two of the world's largest semiconductor manufacturers. The resulting settlement amount in favor of the client was one of the highest in recent ITC history. In addition, Dr. Chen has assisted in a ground-breaking patent litigation brought in Singapore involving Universal Serial Bus (USB) portable flash memories. He has also assisted in the prosecution of various patent applications before the United States Patent and Trademark Office.

Some of Dr. Chen's notable recent engagements include:

  • HTC Corp. and HTC America, Inc. Dr. Chen represents HTC and HTC America in a patent declaratory judgment action relating to microprocessor technology and a patent infringement suit relating to user interface technology. He previously represented HTC and HTC America in four other patent infringement suits relating to various cellular phone technologies.
  • Lite-On IT Corp. Dr. Chen represents Lite-On IT in a patent infringement suit relating to DVD parental control technology. He also represented Lite-On IT in a licensing matter relating to microprocessor technology and an arbitration matter relating to optical disc drive technology.
  • ATEN International, Inc. and ATEN Technology Inc. Dr. Chen represented ATEN International and ATEN Technology (as patent owners) in several patent infringement actions relating to keyboard-video-mouse switch technology.
  • Chunghwa Picture Tubes, Ltd., Tatung Company, Ltd. and Tatung Company of America, Inc. Dr. Chen represented Chunghwa Picture Tubes, Tatung Co. and Tatung Co. of America in a patent infringement suit relating to photolithography technology.
  • ASUSTeK Computer, Inc. and ASUS Computer International, Inc. Dr. Chen represented ASUSTeK and ASUS in a patent declaratory judgment action relating to microprocessor and flash memory storage technologies. The case settled on favorable terms for ASUSTeK and ASUS.

Dr. Chen earned his J.D. from the University of California, Hastings College of the Law, where he was an Articles Editor for Hastings, International and Comparative Law Review. Prior to attending law school, Dr. Chen received a Ph.D. in Industrial Engineering & Engineering Management from Stanford University, with his thesis focusing on semiconductor manufacturing. He received an M.S. in Computer Science and another M.S. in Engineering-Economic Systems from Stanford University. He also received an M.S. in Manufacturing Systems Engineering from the University of Texas at Austin. In addition, Dr. Chen received his B.S. in Mechanical Engineering from National Taiwan University.

Dr. Chen is a member of the California State Bar. He is admitted to the U.S. District Court for the Northern, Central and Southern Districts of California, the U.S. District Court for the Eastern District of Texas and the U.S. Court of Appeals for the Ninth Circuit. In addition, Dr. Chen is a member of the American Bar Association and American Mensa.

Dr. Chen also speaks Mandarin Chinese.
