Are there 2 ComAg agreements?

Moore states in his complaint that he had a ComAg with TPL. He goes on to say that another ComAg was created pursuant to the master agreement. What happened to the original ComAG between Moore and TPL? Was it replaced by the new ComAg?

If it was replaced by the new three party ComAG, then according to the Operating Agreement of the master agreement, only the management committee has the right to approve amendments to the ComAG.

Further along in Moore's complaint he talks about a dispute with TPL which resulted in an Amendment-1 to the ComAg. This amendment mostly addresses how Moore will be paid, however, it also makes reference to TPL commercializing the Array products for Moore.

Did this in effect give TPL the right to commingle Array with MMP? If so, was this approved by the management committe (which includes PTSC)?
