The problem is that there is much doubt, and no strong evidence to the contrary, that PTSC will ever see another dime in revs from future licensing.

Validity is only part of the value of a patent. You also need value and marketability. If no one is willing or compelled to pay for your patent validity alone doesn't mean very much.
