I didn't read it all, but from what I read, they make an absolute case for summary judgement in their favor.

Without expert testimony, this is a "he said, she said" request (or motion) for a summary judgment. There is no reasonable way that a judge can make a ruling on that because there is no evidence, it's all BS talk.
