Based on input from Ron, Barco is the only direct beneficiary of any SJ decision that could go against us. Ron indicated possible indirect help for the others, but I'm not sure what that would be, since a decision against us would simply mean that TPL did not provide enough evidence of infringement to warrant the 336 infringement case going forward against Barco. The 336 infringement case against the other two is unaffected.
However, one has to wonder why Acer and HTC chose not to join in the request for summary judgement? Could it be that TPL has provided the necessary and sufficient evidence to both?
If all TPL can do is defeat the motion, then it boggles the mind as to why Acer and HTC would not take part, UNLESS they have the proof and that would surely come back to hurt them later.
So regarless of what happens with Barco's SJ request, I'm feeling good that we probably have the other two nailed.
