I'm sure someone will correct me if I'm wrong, but the SJM in this instance was dismissed without prejudice. But, that was a decision based on Barco's motion requesting permission to file a surreply and another request for SJ in that motion. I don't think this affects the actual originally filed SJM. That won't happen until the court considers the surreply. If the actual SJM is denied with prejudice, the stock will really pop I imagine.
