The positive is also we have been in a life and death battle and although we seem to be wounded were definitely not dead. I am hoping the infringer signings are over a hundred. With the ex-parte reexam process exhausted alot of companies now must weigh paying the fee or spending the money in court. The fact that we are hopefully going to the mat with our current trial we should be sending a clear message to the infringers. We just need to tidy up our house and either get cracking on either large infringement dollars or nuisance value dolllars. Either way the coffers will begin to fill up and the PPS will rise. Big money(individual licenses) won't come in until after the conclusion of the trial IMO. If I was a CEO of a potential infringer I certainly would be waiting as I would have waited for the USPTO to run its course. The treble damages wouldn't scare me knowing that settlement is always an option.
