No. The statement is not misleading. TPL did in fact get around that much (actually, I think slightly more).
Additionally, are you sure TPL has actually already PAID the invoices presented for reimbursement at the time of reimbursement, or that they are presenting costs to PDS that 3rd parties have billed and that TPL is responsible for paying, so that they can get reimbursed and in turn process the payment with the money they get from PDS. Unless you've seen the books, you don't KNOW how that is happening, and it's not uncommon for 3rd party costs to be incurred and billed, but payment terms to due 30 days later, or something similar.
As for the litigation issue, read the CommAg. TPL is the lead, and PTSC agrees to provide support requested by TPL. Sure we have lawyers representing us, but in fact, per the agreements we signed, TPL is the lead in litigation with respect to the MMP, so how they see best (for whatever reason deemed reasonable) to prosecute litigation re the MMP, is the final authority per the agreements. If you disagree, please reference why.
Lastly, and further on the point above, "our lawyers" also purportedly reviewed and agreed to the documents we signed with TPL. Do you think that those resulted in agreements relative to what MIGHT have been consumated that "damaged PTSC at the same time enabling TPL". I sure do, and PTSC seems to agree since they've now challenged them in court on these agreements.
While I HOPE our lawyers are taking care of us, ultimately, they can only act as their client directs them, so based on HISTORY (I know how everyone here HATES when that is brought up), my confidence in our either our legal consel, or our ability to accept their advice and/or provide them with direction, is VERY LOW, lol.
So, that's the "reference point" from which I post. In turn, why don't you please provide any references that show I should have CONFIDENCE that PTSC legal representation, and our BOD is providing maximum protection to PTSC and these legal delays/maneuvers are fully to OUR benefit as well as TPL's.
