Not being a lawyer, just an observer of this case.
The info for the Markman comes from the patent, how it is written, in its existing state, after reexams; testimony by expert witnesses (opinionating on functionality citing documentation and prior art references used in the reexams - I think) Each word and phrase are scrutinized and argued over by the attornies. Each side seems to want to take advantage of any favorable wording to help prove, or disprove infringement which will be determined later at trial when evidence for such is entered. The more favorable a Markman ruling for one side or another the higher the probability of success at trial (though certainly no guarantee (which we may, or may not have already witnessed (J3))
