I know this one will be expensive but is it not that very expense that you weigh as an infringer to pay or to fight? I don't think attys fees can be recovered in these cases?? So even if we settle for a nuisance value how much did the license cost them with litigation? I agree about raising capital and shareholders but that is a non- issue when it comes to infringers paying up. The fact that they know we can still raise capital to fight will carry some weight in their decision. If the early discount mover programs haven't worked and they are ignoring our negotiated price for licensing then change it to a zero sum game.
