New Pacer--ORDER GRANTING DEFENDANTS’ ADMINISTRATIVE MOTION FOR A
SEALING ORDER (Signed By Judge)
IN THE UNITED STATES DISTRICT COURT
FOR THE NORTHERN DISTRICT OF CALIFORNIA
SAN FRANCISCO DIVISION
Barco N.V.,
Plaintiff,
v.
Patriot Scientific Corp., et al.,
Defendants.

ORDER GRANTING DEFENDANTS’ ADMINISTRATIVE MOTION FOR A
SEALING ORDER

Presently before the Court is Defendants Technology Properties Limited’s and Alliacense
Ltd.’s Administrative Motion for a Sealing Order. (hereafter, “Motion,” Docket Item No. 216.)
Defendants’ Motion seeks an order sealing certain confidential defense documents filed as exhibits
to the parties’ Discovery Dispute Joint Report #2. (Docket Item No. 208.) On September 12, 2011,
Magistrate Judge Lloyd denied Plaintiff’s motion to seal the same exhibits on the ground that
Defendants failed to file and serve a declaration establishing that the designated exhibits were
sealable, as required by Civil Local Rule 79-5(d). (Docket Item No. 214.) Defendants state that
their failure to file a declaration was inadvertent and now move to seal the exhibits on the basis of
two declarations that Defendants contend establish its sealable nature. (Motion at 1-2.) Defendants
also state that Plaintiff has informed them that it intends to oppose the Motion, however to date no
opposition has been filed. (Id. at 2, n.2.) Upon review, the Court finds good cause to seal the
requested material. Accordingly, the Court GRANTS Defendants’ Motion. The Clerk is directed to maintain under seal Exhibits A-1 through A-11, B-1 through B-5, and C-1 through C-5 to the parties’
Discovery Dispute Joint Report #2. (Docket Item No. 208.)
