According to documents filed 12/20/04 in the PTSC vs. Moore., et. al. case, lawyers representing Moore have asked the court (in a 27-page brief) to disqualify PTSC`s New York counsel, as well as PTSC`s Calif counsel and their Georgia counsel (Carlton something, don`t remember his name). Moore`s lawyers have also answered PTSC`s third amended complaint and filed a couple of statements by Moore and another lawyer as to Moore`s relationship w/ Willis Higgins, his and Fish`s lawyer when they filed the original patent applications. According to the 27-pp brief, Cap Beatie, PTSC`s NY counsel, contacted Higgins, has had some 20 meetings with him (``ex parte`` according to the filing), in possible violation of California bar rules and guidelines. Higgins has also invoiced Beatie`s firm for some 30K in expenses. Moore`s lawyers see this as Beatie inducing Higgins to breach lawyer-client confidentiality, which they say he still owes to Moore, and which Moore has never waived. So they want all of PTSC`s lawyers in this case disqualified. Supposedly asking for a hearing for the matter on 4 February. All this can be found on the PACER website for the Northern District of California, though you`ll have to register and pay 7 cents per page. They are public docs, from what I understand, though there are elements redacted. Moore`s lawyers have asked the court to keep some docs sealed from public view, including some depositions (I think Higgins` is one of them). All FYI and only what I`ve seen from a cursory reading of rhe documents. Haven`t seen an answer from PTSC team yet, though it`s probably in the works. First post here, though long since 1998.
