What we do know:

The MMP Portfolio has also been successful in litigation, with eight litigants purchasing licenses.

September 24, 2010 – PTSC announces: Dresser buys license.

October 26, 2010 – PTSC & Alliacense joinly announce Cummins license and Alliacense includes in its PR: Eighty global companies from the US, Europe, Japan, Korea and Taiwan have licensed the MMP Portfolio™ technologies.

Running Tally as of Oct 2010 – 80 MMP Licensees

February 3, 2011 – PTSC announces: Patriot Scientific Corporation (OTC Bulletin Board: PTSC News), The TPL Group, and Alliacense announced today that during December 2010 and January 2011, MMP Patent Portfolio licenses were entered into with several companies in the telecommunications and industrial equipment industry segments.

Running Tally as of Feb 2011 – 80 + “several” means min 83 plus MMP Licensees

February 16, 2011 – PTSC announces: Over 80 global companies from the US, Europe, Japan, Korea and Taiwan have licensed the MMP Portfolio(TM) technologies.

May 23, 2011 – PTSC announces: Stryker buys license.

Running Tally as of May 2011 – “84 plus” MMP Licensees

August 29, 2011 – PTSC files 10K with SEC including: “From the inception of the Commercialization Agreement to May 31, 2011, gross license revenues to PDS totaled $284,923,235.” That revenue tally doesn't include AMD or Intel licenses (min $22.95M). Also Q4 MMP license revenues consisted of $2.24M with the only announced license being Stryker suggesting Stryker paid $2.24M.

September 13, 2011 – Mac Leckrone declares in court filing: To date, over 80 companies have entered into license agreements as part of Alliacense’s licensing program for the MMP Portfolio.

October 7, 2011 – PTSC files 10q with SEC including: “During the three months ended August 31, 2011 and 2010, TPL entered into licensing agreements with third parties, pursuant to which PDS received aggregate proceeds of $512,300 and $0, respectively.” This shows that at least one license was signed in that quarter, though NONE were announced.

Running Tally as of August 2011 – “85 plus” MMP Licensees but still in the 80’s (ie NOT “over 90”)

November 16, 2011 – PTSC & Alliacence both announce: Cymer buys license.

Running Tally as of Nov 2011 – “86 plus” MMP Licensees but still in the 80’s (ie NOT “over 90”)

December 23, 2011 – TPL/PTSC lawyers file brief including: “Over 90 global electronics firms (including Intel, Sony, HP and others) have now licensed the Moore patents from TPL, and the four Asserted Patents have withstood over sixteen reexaminations.”

Running Tally as of Dec 2011 – “91 plus” MMP Licensees but still in the 80’s (ie NOT “over 90”)

What is the conclusion?! Hard to know for sure based on the way the info has been disseminated, but it appears that either since the Cymer license was signed that TPL has signed up an ADDITIONAL 5 licenses, OR, that there were at least one or more quarters of the last 3 that have been filed with the SEC that included one or more unannounced licenses.

Based on the way the language has been used, it suggests that the licenses that put us over the 90 threshold are more recent.Hopefully that means that this quarter to be released in January will have a surprise upside, or that the current quarter will include some licenses that we haven’t heard about.
