We certainly were TOLD that it was favorable.
HOWEVER, when you look at the licensing before and after the ruling, perhaps it reveals something quite different.
Prior to the June 18, 2007 ruling there were 19 MMP licenses sold (including AMD & Intel) for a total of $193.82M in fees. That's an AVERAGE of $10.2M per license.
Since the ruling, there as been AT LEAST 72 MMP licenses sold if we can believe what PTSC/TPL has filed with the court. That has been for a total of AT LEAST $114.6M. That's an AVERAGE of $1.6M per license.
At approximately the same time, Markman ruling came out, the USPTO granted the re-exams and that process began, so it's difficult to say what had the greatest influence on the licensing program, but it clearly appears as though the previous Markman ruling may have not been as favorable has has been spun by TPL, based on their subsequent ability to collect licensing fees.
Let's hope the Friday is the start of something more in line with pre June 18, 2007 licensing!
