Personally (lol), IF we get a favorable Markman in Cali, which is considered more friendly to those being accused of infringement, I would file in Cali and move forward considering we would have prevailed in an unfriendly district to our business model. Also, most likely after the reexams, it would make better sense to go back to Cali as Cali wouldve been the most recent district to review the patents.
