I understand the Markman ruling and the Special Masters concerns are separate issues. It still bothers me that TPL was admonished for lack of clarification concerning specific infringement. While Barco intervened, it still has shades of the ARM scenario written all over it. I don't have the legal knowledge to understand what the implications would be if the SM decided TPL could not make a legitimate connection regarding specific infringement. A strong Markman on one hand and a weak position against Barco on the other? What is the potential backlash of such an outcome?
