Operative word being "major". That is what the judge is paid for, not the specialist.
There is about an avg 40% reversal rate on Judges decisions concerning these matters(patent scope). I think its smart to bring in someone who has the expertise to help the Judge to see things, or look at things in a different light.
The specialist in our case is young and does not have a proven track record in the industry like some of the experts (Dr. Wolfe and Dr. Otteson). So leaving major decisions to a specialist would be concerning.
Every post you make does not relate to the core issues being disputed. This entire thread is discussing peripheral issues. The specialist? Gosh I hope it doesn't come down to him.
