What's changed? We won the first MH. We successfully navigated all the re-examinations and the results have been exactly the same

During the first Markman there were multiple Reexams going on... then during the multiple reexams there was the T3 litigation... Now there is just the Markman.. A successful Markman will increase the likely hood of a settlement.. but that is no sure thing.. A successful Markman gives us a legit chance of defeating the T3 should they still decide to go the distance... the side that wins the Claim Const, and to what degree that victory is, will gain the advantage in this litigation...

The MMP needs to be legit in the eyes of the infringers for them to start paying anything besides nuisance fees... at this point in time, that starts with this Markman Ruling...
