I would add the courts will not allow this issue to be litigated again. This is it and all of the core points will have been fully litigated. Any future litigation after the T3, providing a favorable Markman, will gon through Judge Ware (who would be an expert on the subject matter and would not tolerate bogus arguments) with some discovery and then ICs would be presented, and then motions for summary judgement would be submitted by TPL and then the judge would rule on said motions and if TPL didn't win the motion we would proceed to trial. I view this entire situation as a game of musical chairs. If we get a favorable Markman, then the music speeds up and the chairs become increasingly occupied as time goes on. IMO there will be someone without a chair at the end so TPL can go out with a bang. All predicated on a favorable Markman.
