And TPL managed to turn it into a negative for US!

How did TPL manage to turn it into a negative..? Because they chose the course of action to settle the J3 and put all their energy and monies into successful Recertifications of the patents.. instead of allowing the J3 to have a hand in their outcome via the trial?

Step 1- Successfully defend the assault on the validity of the patents and secure Recertified Patents - CHECK

Step 2- Win the Markman at trial..

While I have many issues with Leckrone & TPL.. their choice to settle the J3 and concentrate on successful Recerts is not one of them... Disappointing.. sure.. but was it the correct play.. imo yes.. ymmv
