I hear ya and I am hopeful of the same. I don't think the reexaminer (really called the examiner) will testify as he essentially already has by issuing the final office action at the USPTO. I think we can present our argument and discuss what was said with the reexaminer and TPL has the initiative, but they will need to convince Judge Ware. They obviously didn't convince him the first time. I give credit to Judge Ware, he seems very conscientious of all the terms and is doing his best to arrive at the core ideas of the Moore and Fish inventions. He could've ruled against us on the ring oscillator term but he didn't. Now we just need to make a clear and convincing argument. How I would love to attend that briefing.
