Assuming a decisively favorable Markman:

Is it likely that given a settlement, TPL/Patriot will ask for reimbursement of all legal costs or is this something that they would ask for only if there is win in a jury trial?

Any guesses as to what that amount might be? Considering the amounts that PDS has reported as legal expenses, would the court consider all these expenses as usual and customary. In other words, if the expenses have been padded is it possible that the court would say these are not usual and customary expenses?

Also, what if the amounts that TPL has asked for reimbursement from PDS is not the same amount that TPL has actually paid to the attorneys would there ever be a time where the court would ask to compare TPL's books to those of PDS? Or would that only happen if PTSC were ever to sue TPL again?
