I agree with the two scenarios regarding the Markman outcome. They either have the goods and believe it after the first NDoC Markman, or they are worried about the Markman and want to try and influence, however slightly, the courts via the ITC and new assertions of infringement against new tech companies in the NDoC. Or, they need to drum up some licenses to get some revenue to pay for the remaning fight against the T3.
