Technology Properties Limited (TPL) and Patriot Scientific Corporation (PTSC), have filed a complaint with the US International Trade Commission (ITC) and corresponding complaints in the US District Court for the Northern District of California against 13 companies believed to be infringing the MMP Portfolio patents............

The 13 ITC respondents are: Acer Inc., Amazon.com Inc., Barnes & Noble Inc., Garmin Ltd., HTC Corporation, Huawei Technologies Co. Ltd., Kyocera Corporation, LG Electronics, Nintendo Co. Ltd., Novatel Wireless Inc., Samsung Electronics Co. Ltd., Sierra Wireless Inc., and ZTE Corporation

Can anyone confirm that the 13 ITC respondents above are also named in 13 new complaints filed with the Northern District of California? Could it be that the corresponding complaints mentioned above are in fact only the existing T3 cases and not any new cases? Anyone with Pacer access should be able to find new case filings, correct?

Acer submits the following initial comments on public interest

issues in response to the Commission’s Notice of Receipt of Complaint; Solicitation of

Comments Relating to the Public Interest. 77 Fed. Reg. 44671 (July 30, 2012) (“Notice”).This is the third action brought by TPL against Acer – one in district court and two in the ITC. In this proposed investigation, TPL appears to seek an exclusion order on some Acer products that are already accused in the pending 337-TA-841 investigation. The district court case involves the same patent asserted in this action, and has been pending for over four (4) years and a claim construction order recently was entered in that case. There is a public interest in preventing an entity such as TPL from repeatedly bringing 337 actions against a proposed party and requesting an exclusion order of products that overlap previous investigations.
