How could anyone know (Apple or TPL) the jury in the Apple vs Samsung case would find in favor of Apple? How could anyone know if the case would be essentially throwin out of court like another high profile case. As you say the deal was done so long ago there is virtually no reasonable explanation that could make this alleged contingency deal be realistic. I'm not trying to be difficult, but this is far fetched and smells of the J3 contingency/conspiracy theory.
