Manufacturing and assembly companies such as Foxconn go to great lengths to keep their distance from being design-responsible for the express purpose that they not be dragged into court for product failure liability etc. I would guess that they are off the hook for infringement for the same reasons..I'd be very surprised if Foxconn is brought into any infringement cases in the context of MMP liability etc.
