ORDER NO. 5: GRANTING UNOPPOSED MOTION FOR AN EXTENSION OF
TIME TO SERVE RESPONSES TO COMPLAINANTS’
INTERROGATORIES AND REQUESTS FOR PRODUCTION
(September 10, 2012)
On September 7, 2012, Respondents Sierra Wireless, Inc. and Sierra Wireless America,
Inc. (collectively, "Sierra") filed a motion requesting an extension of time until September 21,
2012 to serve responses to Complainants’ interrogatories and requests for production. (Motion
Docket No. 853-002.) Sierra asserts that good cause exists for the requested extension because it
would allow Sierra to better evaluate its positions in order to respond more fully; because it is
still early in the Investigation; and because the extension will not prejudice any of the parties or
cause undue delay. (Mot. at 1.)
The Administrative Law Judge finds that Sierra’s motion (Motion Docket No. 853-002)
should be GRANTED. Further, the Administrative Law Judge notes that this is the second
motion requesting the same extension. Parties with similar interests should coordinate and
consolidate motion practice to the extent practicable. Further, under Ground Rule 3.2, the parties
may stipulate to extensions of time for discovery responses to avoid the need for such motions.
