but for license valuing purposes, that is not how it works.

That is especially NOT how it works when a company has a historical record of pricing with their IP. That historical record of per chip infringment pricings from previously sold licenses is one component that can be used to determine the reasonableness of what other infringers should pay.

Patriots own expert has stated as much in a sworn declaration.
