Pursant to Order No. 7, Setting the Procedural Schedule (October 1, 2012), the Commission Investigative Staff hereby gives notice that it may rely upon: (i) prior art contained within the prosecution history of the asserted patent; (ii) prior art contained within the prosecution histories of patents or patent applications related to the asserted patent; (iii) prior art identified by one or more of the private parties in a notice of prior art; (iv) prior art offered by one or more of the private parties into evidence at the hearing; and (v) prior art identified during the remainder of discovery.
