My take (with acknowledged technical ignorance) is that we clearly won the Markman.
With regard to the '336/ring oscillator, I agree with ease and others, and believe the problematic word was "uncontrolable". Put another way, the words "....variable based on the temperature, voltage and process parameters in the environment" are the beauty of the '336 and incorporation of the second clock ring oscillator adjacent to the CPU. Read the patent, which has a title that begins with the words "Variable speed" if I recall correctly. These things that make it variable are precisely what is stipulated in the patent.
IMO, we only "lost" on one construction, and I too believe it has to do with the '890. In my ignorance, it's somewhat trivial in the scheme of things and I don't care.
Most shocking to me is that everyone seems to be overlooking one major issue to be addressed in the MH2: Talbot. While I don't believe it was necessarily a true claim construction issue, it was a huge issue as it had to do with VALIDITY (not so much Infringement - directly). My read is that the Talbot issue died a miserable death because the Judge recognized that the argument was bogus - as many here suggested and believed. This may be the biggest victory of all. The ruling is silent on this issue, and I strongly suspect that if it remained an issue it would have been mentioned.
