Well, no. You're the one who is citing 4 specific briefs that you claim show TPL argued AGAINST including that language. If you can't provide the links and cite the portions of the briefs that you're claiming support your view, then it would seem you are trying to mislead. I'm open to hearing your argument, but only if you can support it and quickly. Otherwise, it would seem their views are justified.
