I don't really understand your last paragraph. I'm not trying to come up with scenarios. I agree that the prior art for the '336 is probably just about all known by now. But, sure, the accused companies will naturally continue to fight, and will argue in court (if they can) that the '336 is invalid, for whatever reasons they can come up with. As you probably know, there are bases of invalidity that can be used in court that cannot be used in the reexamination process.
