This is from a USITC document dated Dec 7th written by the Investigative Staff.

<Additionally, there is only a single asserted patent, and the procedural schedule in this investigation provides adequate deadlines for claim construction discovery (Order No. 7).>

The single asserted patent at the USITC is the 336.

What you posted must have been taken out of context.
