It is the EH guy. He is 100% wrong ... And think about it indirectly my Deutsche friend, if we lost the 336 in the claim construction, then why aren't we asking for a 4th Markman at the ITC? If we lost we would be asking for it. Instead, the Goliaths are asking for it and we are saying Judges Ward, Ware and Grewal made the correct decisions for the 336 in the first 3 Markmans. The 336 is the only patent at issue at the ITC. The only conclusion from indirect events (I am 100% confident we won the 336 based on the ruling itself) is that we won the 336. EH can chase the SP and I hope he doesn't get back in at a price he could've. I have no patience for these posters.
