I agree the word "preserved" is not a word I would use in an advertisement, but I know the Markmans 1 and 2 in the NDoC were solidly in favor of PTSC for the 336. I also feel the first Markman announcement was enough to convey the MMP strength to the world and the main issues were settled in the first Markman in large part. I believe Judge Ware was more concerned about the Talbot oscillator being considered a ring oscillator than it being noncontrollable. We could talk about that conversation for a long time. So I don't think Alliacense wants to announce again and then they would have to announce again after a possibly favorable ITC markman. Would it be nice to get a PR for piece of mind regarding highly technical, non-intuitive technology? Yes, but IMO at this point it is not necessary.
