Ron. In the NDOC case, the plaintiffs had a much longer timeframe in which to cement their claims construction and there was only three of them. In the ITC case, the dirty dozen has been given until March 5. Is this not an incredibly short time for so many companies and their lawyers, to consolidate and present a unified proposal? Who is going to take the lead etc.
Who knows if they can even develop and then compromise on new claims....because surely this judge will be well aware of the other failed attempts to convince the court. What am I missing? Nothing is a slam dunk, but these guys got their work cut out for them, no? I am thinking this deadline may cause alot of them to fold.
