Again, to be clear, I am not arguing that there is now a contingency license in existence between TPL/PTSC and an infringer that hinges on the outcome of the Markman hearings. I am simply arguing that to dismiss the possibility that one could exist based on the arguments I've read here wouldn't make sense to me.
