Both are refering to Amazon.com Inc... The original '07 letter infers approximately $130M of royalty exposure for past damages.. the recent letter to Amazon.com Inc states Amazon and its affiliates should pay damages of approximately $42 million. If royalty exposure for past damages and damages are assumed to be one and the same, then for some reason TPL's orignal estimation, which did not state 'could be as much as' or 'with treble damage could be..' was off by some $90M.. or 200%.. Really?

The damages Amazon is responsible for, if the first number by TPL was in anyway accurate should now be $150-175M... unless they were just shootin' from the hip back in '07.. which would make them look like shmucks...

My question is.. What was Amazon producing pre '07 that added up to $130M in royalty exposure damages?? or was TPL going after every infringing product that they had sold, not produced.. and/or is $42M an adjusted number due to the friggin' SC Quantra ruling?
