I don't think we got hammered, but it appears the respondents are looking to have the 336 be defined as being more strictly controlled via "varying proportionally", "directly" (i think that is in there). Can you post the file for all to see? The "noncontrollable" section is not there, and it appears in the reasoning of the staff they did attempt to use what Grewal and Ware used. I am a little confused in the staff's Markman recommendation vs their recommendation the ITC did not need a Markman as Ward, Ware and Grewal had already construed the claims.
