I agree that TPL's response or argument to the ITC Staff findings would tell all. However, after reading through it all, it appears in several cases, TPL tried to tweak vebage that had already been established by the patent office or the courts. I don't know why TPL would change things, unless it was a strategy to make certain points stronger. The changes the ITC staff made primarily (IMO), were just conversions back to what the courts or the patent office had previously agreed to. Also, in my opinion, these ITC staff people are good. They seem to understand the terms better than the judges. They did make a few changes that make issues perfectly clear now. This should once and for all remove all questions for the claim terms. Claim #6 was confusing to me, as to what may have changed. I don't think we were really hurt, but the real issue is infringement, not just claim terms.
