This time things feel different......
I would agree that not only does this Judge appears to be through and fair but in my opinion this case as it is also seems to be different at least to this point then what we have experienced in past.
I would find it hard to believe that after all this time has gone by with just this one case that there have not been overtures made for TPL to take our typical "nuisance" settlement that TPL has made habit of taking and running with.
It appears that maybe the Leckys have decided that either they do not need the money that badly this time or maybe just maybe they have seen the light and realized that at this late date they had better stand up and be counted for seeing this through to a proper settlement or trial or yes even a loss as one way or the other, push come to shove PTSC and TPL needs to make good use of their remaining time.
I know I should be biting my tounge but it is my hope that win or lose this time with TPL having a Tiger by the tail they will not let it go until they see this through to the proper end.
With a win I believe that they will finally be sending a message of strength to all the remaining infringers. A scenario that says .... "make my day" we will not go quietly and cheaply into the night. This time we will meet the infringer in court rather then take pennies to go home.
It is my hope that these thoughts are not wishful thinking but is really what is going on in the heads of Lecky.
Lastly, I am not sure how many shares in varioius entities that the Swartz group still controls but if they are still in the game (I believe they are) they may be the ones saying that no more nuisance settlements because with all of the ones we have had over the years the only Swartz related individual who has profited by most of them is CJ and that does not help the big man out but in fact makes him one of us.
Of course all of the above is just my opinion
God Bless
