The only way I can see to "bow out" prior to a trial in the ITC is by settlement, which would obviously occur prior to a judgment of infringment (unless there is a motion for summary judgment filed).

Ron,

Does a summary judgement provide a judgement of infringment without the trial, or, is it part of the process of ending proceedings via a settlement?
