I received a very fast reply from Mr. Flowers yesterday answering my questions re: TPL filing bankruptcy and I guess it's ok if I post the most relevant (IMHO) part from his mail:

"We are always very careful in evaluating our disclosure obligations and if you do not see a communication from us please do not assume that it due to a failure over the matter having been fully considered.

Absent an obligation to disclose, what we do or don't say is largely driven by what we believe is best for the continuity of the litigation and licensing efforts."

So I think one can assume that the company doesn't see this event as a threat to its one and only and most valuable asset.
