just because it was "planned" does not mean things go as they prefer or would like or hope.

Just like the claims of infringment we have been embroiled in for years, there are impacted opposing Parties who have an opportunity of something to say or influence about it.

I am trying to explain that the BK is only one's side position, the other side has yet to even fire their first salvo, if they intend to.

I would be very careful about dismissing the potential fallout from this. Won't happen overnight, but as the months pass, I think we're likely to see this isn't at all as benign for those connected to TPL as many here apparently believe. If so, the question then becomes, what can/will they do about it.
