The muliple shifting in arguments on the 21st, ended with a request to impose no stay on counterclaims by defendant based on previous cases. So, at first, this might seem like a no brainer. We have the US code and prior precedence to back it up. Is the stickler the fact that the defendants have not countersued or actually filed suit against the T's and so the code does not apply. Maybe, this why TPL now wants to remove all stays in order to proceed. Does it make sense to say you can't stay actions because you have counterclaims... you must have filed suit therefore it has a case number? This is confusing I'm sure, but give me a little slack ....Ihave a severe ear infection, four prescriptions etc., Good luck to all of us in the short term.....that is my need. I thought we might see some near term appreciation and now I am not so sure.
