My point was "It should be noted here that any single patented solution can be circumvented". I thought I was clear.
It's true that "Workarounds do not eliminate past infringement.". However, it sure makes import restrictions unlikely on any products that switch to using a workaround.
But as I said, workarounds take time and money, licensing after long legal delays might be the best option for infringers in most cases.
