I have no doubt that is the case. But how does that answer the question of whether a PLL must be relied on for the VCO to generate a clock signal?
If the ALJ wanted to dismiss any control over the VCO, perhaps he would have chosen to accept respondents construction of Ring Oscillator Variable Speed Clock as NON-CONTOLLABLE. But he didn't.
IMO, controlling the VCO is a different question from Relying on the Crystal Clock to generate a clock signal.
