Technically, that is correct. I would only ask what happens to these companies if they are prevented from selling their products in the most lucrative market in the world? There is a huge incentive to settle for big dollars to reopen the US market to their market. Every month that goes by would cost $100s of millions of lost revenue per each month. An ITC win is as good as the NoCal, or even better because it is one thing to have to pay a penalty of 50 to 100 million on the accused products in NoCal, it is extremely acute if the products can't even be sold. Honestly, I would rather pay a penalty (NoCal) then not even be able to work to generate income (ITC). The above has been confirmed with Cliff.
